HomeMy WebLinkAbout3RD ST W 440 07/27/2005Community Development Department CERTIFICATE OF APPROPRIATENESS APRIL 26, 2016 440 W. 3RD STREET * TUSTIN BUILDING OUR FUTURE HONORING OUR PAST The project is for the construction of a new single -story detached 2 -car garage with attic and workshop with a toilet room at the residence located at 440 W. 3rd Street. The application is identified as Design Review 2015-007 (DR 2015-007). The project site is zoned R1 Single Family Residential and is within the Cultural Resource Overlay (CR) District. The property is listed on the City of Tustin Historic Resource Survey and was built in approximately 1952. It is listed as a "C" rating and categorized in the theme of "residential architecture, suburbanization". Pursuant to TCC 9252, a Certificate of Appropriateness is required subject to specific findings. The proposed new two -car garage is located at the rear of the property. The single -story garage structure with attic will provide two (2) 10 foot by 20 foot parking spaces with two swinging garage doors on automatic openers. An approximate 6 foot by 16 foot workshop and a small commode accessible to the exterior only occupy the rear portion of the first story. A 20 inch by 30 inch attic access provides entry to the storage area above the garage. The garage will be finished with two (2) inch bevel siding along the lower half of the structure and eight (8) inch bevel siding on the upper section. The garage will be painted to match the existing main house. Siding will be painted in Dorian Gray (Sherman Williams #SW7017), accent color on eaves, eave overhang corbels will be Iron Ore (Sherman Williams #SW7069), and trim of window and door casings will be Eider White (Sherwin Williams #SW7014). The existing garage structure attached to the main residence will be removed and the exterior of the residence will be repaired. Materials are to match the existing residence in type, texture, and color. In accordance with TCC 9252h2, the following required findings for construction or alteration may be made: 1. Construction of improvements in the CR District. (a) The proposed work conforms to the Municipal Code and design standards which may be established from time to time by the Historic Resources Committee. The proposed improvements conform to the Tustin City Code and any applicable design standards in that the proposed project meets Zoning Code and Building Code requirements. (b) The proposed work does not adversely affect the character of the district or Designated Cultural Resources within the district. The proposed two -car garage will provide covered parking for two vehicles as required by Tustin City Code 9263. The new single -story garage structure with workshop, toilet room, and upstairs attic for storage will be. constructed at the rear of the property in a mass and scale proportionate to the site. (c) The proposed work is harmonious with existing surroundings. The extent of harmony shall be evaluated in terms of appropriateness of materials, scale, size, height, placement and use of a new building or structure in relationship to existing buildings and structures and the surrounding setting. The proposed work is sufficiently separated so as not to detract from the original 1952 residential structure. The garage exterior will be finished in a wood siding painted to match the colors of the existing main residence. The proposed work is hereby approved, subject to the following conditions: 1. Prior to the start of any work, the applicant shall obtain a building permit and pay all applicable plan check and permit fees. 2. Attic shall not be an occupiable space (as defined by the CA Building Code). The garage may not be used for, or modified for use for, human occupation but shall be maintained for use as a garage, workshop, exterior accessed commode and related storage only. The garage shall not be modified or expanded beyond the dimensions depicted on the approved Building Permit without the approval of the City of Tustin. This condition and restriction contained herein shall be binding on each successive owner of any legal or equitable interest in the subject property. 3. Second level storage/non-habitable space (as defined by the CA Building Code) shall be accessible by an opening of 20"x 30". Stairway is not permitted except by fixed access attic ladder. 4. Prior to issuance of any permit, the applicant shall enter into an Agreement to Construct Sidewalks at a future date upon demand by the City of Tustin. 5. Prior to any work in the public right-of-way, an Encroachment Permit shall be obtained from and applicable fees paid to the Public Works Department. 6. Prior to issuance of a Building Permit(s), the applicant shall provide written approval from the Orange County Sanitation District for sewer connection. 7. Construction and Demolition Waste Recycling and Reduction Plan (WRRP). Certificate of Appropriateness* 440 W. 31d Street DR 2015-007 • a. The applicant/contractor is required to submit a WRRP to the Public Works Department. The WRRP must indicate how the applicant will comply with the City's requirement (City Code Section 4351, et al) to recycle at least 50% of the project waste material or the amount required by the California Green Building Standards Code. b. The applicant may be required to submit a $50.00 application fee and a cash security deposit. Based on the review of the submitted Waste Management Plan, the cash security deposit in the amount of five (5) percent of the project's valuation as determined by the Building Official, rounded to the nearest thousand. The minimum deposit amount shall by $500 and the maximum deposit amount shall be $2,500. c. Prior to issuance of a permit, the applicant shall submit the required security deposit in the form of cash, cashier's check, personal check, or money order made payable to the "City of Tustin". 8. Any damage done to existing public street improvements and/or utilities shall be repaired to the satisfaction of the City Engineer. 9. Prior to project final, the existing unpermitted attached garage structure is to be removed and the exterior of residence is to be repaired with materials to match existing residence in type, texture, and color. Field inspection shall be conducted to verify consistency with the approved set of plans. Elizabeth A.
