HomeMy WebLinkAboutORD 1499 (2018)INITIATIVE ORDINANCE NO. 1499 AN ORDINANCE OF THE PEOPLE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 2703 OF THE TUSTIN CITY CODE TO INCREASE THE TRANSIENT OCCUPANCY TAX The People of the City of Tustin hereby ordain as follows: WHEREAS, a measure to increase the transient occupancy tax was put before the voters at a general municipal election held on November 6, 2018; and WHEREAS, the measure received the requisite votes for adoption. NOW, THEREFORE, the people of the City of Tustin do ordain as follows: Section 1. Section 2703 of the Tustin City Code, entitled "Tax Imposed" is amended to provide as follows: "For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of thirteen percent (13%) of the rent charged by the operator. The tax constitutes a debt owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient ceasing to occupy space in the hotel. If for any reason the tax due is not paid to the operator of the hotel, the City Treasurer may require that such tax shall be paid directly to the City Treasurer."
