MAIN STREET TUSTIN BUILDING OUR FUTURE HONORING OUR PAST The project site is zoned Single Family Residential (R1) and is located within the Cultural Resource Overlay (CR) District. The property is listed on the City of Tustin Historic Resource Survey and was built in 1950. It is listed with an "S3" rating and is significant because of its use of stone on the fagade of the primary residence and historic garage. The proposed project includes the conversion of an existing detached two -car garage to a second residential unit with a one -car garage and the construction of a freestanding pergola at the residence located at 415 W. Main Street. Pursuant to TCC 9252, a Certificate of Appropriateness is required subject to specific findings. The proposed second residential unit and detached pergola are located at the rear of the property and will not be visible from the public right-of-way. Second unit will be approximately 390 square -feet in size and will include a kitchen, an open living area with closet, and a restroom with sink, commode, and walk-in bathtub/shower. The 242 square - foot garage will provide a 10 foot by 24 foot enclosed parking space with a brown carriage - style garage door. Freestanding 228 square -foot wooden pergola will be constructed adjacent to historic garage. Materials are to match the existing structure in type, texture, and color. In accordance with TCC 9252h2, the following required findings for construction or alteration may be made: 1. Construction of improvements in the CR District. (a) The proposed work conforms to the Municipal Code and design standards which may be established from time to time by the Historic Resources Committee. The proposed improvements conform to the Tustin City Code and any applicable design standards in that the proposed project meets Zoning Code and Building Code requirements, and Residential Design Guidelines. Existing historic garage is listed within the City's Historic Resource Survey and structure appears to be eligible as an individual property for the National Register. As providing a new garage space or access to a new garage could result in the significant alteration or demolition of a historic structure listed in the City's Historical Resources Survey, the existing historic garage may be used to satisfy off-street parking requirements for the primary residence. The second residential unit meets the minimum residential parking requirements for a second residential unit. Main Street May 16, 2016 (b) The proposed work does not adversely affect the character of the district or Designated Cultural Resources within the district. The proposed second residential unit is screened from view and will provide enclosed parking for one vehicle as required by Tustin City Code 9263. Additional historic garage satisfies off-street parking requirements for the primary residence. The existing garage structure to be converted is located at the rear of the property and the mass and scale are proportionate to the site. (c) The proposed work is harmonious with existing surroundings. The extent of harmony shall be evaluated in terms of appropriateness of materials, scale, size, height, placement and use of a new building or structure in relationship to existing buildings and structures and the surrounding setting. The proposed improvements are sufficiently separated so as not to detract from the original 1950 residential structure and historic garage. The garage exterior will be finished in stucco to match the existing exterior materials and the pergola will be constructed from wood and stained walnut color. Pursuant to Section 9272(c) of the Tustin City Code, the Community Development Department finds that the location, size, architectural features, and general appearance of the proposed project will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Community Development Department has considered at least the following items: • Height, bulk, and area of buildings. • Setbacks and site planning. • Exterior materials and colors. • Type and pitch of roofs. • Size and spacing of windows, doors, and other openings. • Roof structures. • Physical relationship of proposed structures to existing structures in the neighborhood. • Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. • Development Guidelines and criteria as adopted by the City Council. The findings may be supported by the following: The height, bulk, and area of the proposed second unit, single -car garage, and pergola will be consistent with the existing site, CR District, the Old Town area, and the R1 Zoning District requirements. Setbacks and site planning of the proposed detached second residential unit with single -car garage is consistent with the neighboring residential uses and is compatible with the Old Town Tustin community. Second residential unit and wooden pergola are not viewable from the public right-of-way. 3. Sufficient access and maneuvering room has been provided for the proposed single -car garage servicing the second residential unit. Existing 19 foot by 19 foot historic garage is provided to meet off-street parking requirements for the primary residence. 4. Exterior colors and materials are proposed to match the existing structure and will be consistent with the City's Cultural Resource District Residential Design Guidelines. 5. No change is proposed to the type and pitch of roof for the existing structure. Reroof of the existing structure is proposed. Roofing will complement existing materials utilized at project site. 6. The size and spacing of windows and doors for the second unit are compatible with the existing primary residence. Second residential unit will not be viewable from the public right-of-way. 7. The proposed second residential unit is a single -story structure to the rear of the existing single-family residence. Conversion of structure to a second unit with single -car garage would not alter the appearance or design relationship of the proposed structure and the relationship of structure at the project site. 8. The proposed improvements meet development guidelines and criteria as adopted by the City Council including the Residential Design Guidelines. 9. Existing unpermitted modifications to the historic garage on site are to be removed and garage is to be restored to its previously permitted state. The proposed work is hereby approved, subject to the following conditions: 1. Prior to the start of any work, the applicant shall obtain a building permit(s) and pay all applicable plan check and permit fees. 2. Prior to issuance of a building permit(s), the applicant shall provide written approval from the Orange County Sanitation District for sewer connection. 3. Prior to any work in the public right-of-way, an Encroachment Permit shall be obtained from and applicable fees paid to the Public Works Department. 4. Any damage done to existing public street improvements and/or utilities shall be repaired to the satisfaction of the City Engineer. SACdd\Samantha\Certificate of Appropriateness\415 W. The applicant/contractor is required to submit a WRRP to the Public Works Department. The WRRP must indicate how the applicant will comply with the City's requirement (City Code Section 4351, et al) to recycle at least 50% of the project waste material or the amount required by the California Green Building Standards Code. The applicant may be required to submit a $50.00 application fee and a cash security deposit. Based on the review of the submitted Waste Management Plan, the cash security deposit in the amount of five (5) percent of the project's valuation as determined by the Building Official, rounded to the nearest thousand. The minimum deposit amount shall by $500 and the maximum deposit amount shall be $2,500. c. Prior to issuance of a permit, the applicant shall submit the required security deposit in the form of cash, cashier's check, personal check, or money order made payable to the "City of Tustin". 6. Prior to final inspection, unpermitted alterations shall be removed and restored to their previously permitted state, including the removal of an unpermitted restroom within the historic detached garage structure. 7. Prior to final inspection, recreation vehicle shall be removed from the subject property and comply with Tustin City Code (TCC) Section 9266c.2 and 3 regarding recreational vehicles. 8. All improvements shall be made as shown on the approved plans on file with the Community Development Department, shall match the existing exterior materials, finish, and colors of the existing structures, and is subject to field verification prior to final permit approval. izabeth A.
