The project site is located within the Cultural Resources Overlay District (CR) and structure is listed on the City's 1990 and 2003 Historic Resources Survey. The National Register of Historic Places (NRNP) status code (3S) indicates that the structure, constructed in 1915, is eligible for the National Register as an individual property through survey evaluation. The City of Tustin Historical Resources Survey (2003) described the site as follows The building is significant because of its early association with the emerging automobile and other transportation modes in Tustin as well as its connection with prominent Tustin community members. In addition, it is a surviving variation of the Mission Revival style adapted to a commercial building. The proposed exterior change includes the installation of one (1) additional projecting wall sign to include a marlin sculptor measuring approximately 6'-0" x 2'-0" located at the corner of the building at the 6"' Street elevation. The proposed metal sculptor is 3- dimensional, black in color, and proposed to match the existing marlin sculptor located at the front entrance of the business on EI Camino Real. (Building Permit No. S2016-0030) As this building is built to the property line, the projecting sign will project over the public right-of-way. As proposed and conditioned, the signs would be a minimum of 8 feet above grade, which satisfies both public works and building clearance requirements. In addition to standard building permits, the projecting sign would be subject to approval by the City Engineer, and the applicant must obtain and maintain a valid encroachment permit and license agreement from the Public Works Department. Section 9252j1 of the Tustin Municipal Code authorizes the City Council to establish design criteria for the Cultural Resources District as necessary to supplement the provisions of the District, including acceptable accessories such as signs, banners, flags, and projections. Section 9252j3(a) gives the City Council the authority to permit a nonlisted use which supports the purpose of the District as a conditional use following a public hearing and recommendation from the Planning Commission. On April 7, 2009, the City Council adopted Resolution No. 09-15 approving Conditional Use Permit (CUP) 09-002 and Design Review (DR) 09-003 to install two (2) projecting signs on the building at 560 EI Camino Real (Beach Pit BBQ). 300 Centennial Way, Tustin, CA 92780 0 P:(714)573-3100 9 F:(714)573-3113 0 www.tustinca.org Certificate of Appropriateness 560 EI Camino Real July 28, 2016 The proposed one (1) additional projecting sign can be supported by the following findings: That on April 7, 2009, the Tustin City Council adopted Resolution No. 09-15 approving Conditional Use Permit (CUP) 09-002 and Design Review (DR) 09-003 to install two (2) projecting signs on the building at 560 EI Camino Real (Beach Pit BBQ). As proposed, the installation of one (1) additional projecting sign at 560 EI Camino Real is in keeping with the spirit of the original approval. 2. The proposed work conforms to the Municipal Code and any applicable design standards in that the proposed project meets zoning code and building code requirements. The proposed work will not detrimentally alter, destroy or adversely affect the structure in that the sign is designed in a style that is compatible with the industrial style of the building and will be installed so that it could be removed in the future without altering the structure of the building. 3. The proposed work does not adversely affect the character of the District or Designated Cultural Resources within the District in that signage is designed to complement the building and is similar to signs historically seen within the Cultural Resources District. 4. The proposed work is harmonious with existing surroundings. The proposed modification will retain the essential elements that make the structure culturally significant in that the proposed signage is an addition to the exterior of the building and does not alter the appearance of the building other than through the addition of the projecting sign. The proposed work is hereby approved, subject to the following conditions: 1. Prior to the start of any work, the applicant shall obtain a building permit and pay all applicable plan check and permit fees. 2. Prior to any work in the public right-of-way, an Encroachment Permit shall be obtained from and applicable fees paid to the Public Works Department. 3. Prior to permit issuance, the applicant shall revise the existing Projecting Wall Sign Revocable License Agreement with the City of Tustin Public Works Department. 4. Signage shall be installed at a minimum of eight (8) feet from the grade level so as not to interfere with pedestrian activity within the right-of-way. 5. All conditions of approval for CUP 09-002 and DR 09-003 shall remain valid. 6. Any replacement or repair of any part of existing structure shall match the existing exterior materials, finish, and colors of the existing structure. 7.
