That a proper application, Design Review 95- 017, was filed by Leonard and Kay Nettles to authorize the conversion of an existing residential structure to a commercial coffee shop and modify the site to accommodate a parking area and outdoor patios at 180 El Camino Real. B. That the project is located within the Town Center Redevelopment area. Pursuant to City Code Section 9299(b) (3) (c), the Zoning Administrator has the authority to approve Design Review applications within the City's Redevelopment Areas. C. That the project is located within the Cultural Resources Overlay District which requires the Community Development Department to issue a Certificate of Appropriateness prior to issuance of building permits. D. Pursuant to Section 9272 of the Tustin Municipal Code, the Zoning Administrator finds that the architectural features, materials and colors will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Zoning Administrator has considered at least the following items: 1. Exterior materials and colors. 2. Type and pitch of roofs. 3. Towers, chimneys, roof structures, flagpoles, radio and television antennae. 4. Location, height and exterior illumination. standards of 5. App~arance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 7. Proposed signing. 8. Development Guidelines and criteria as adopted by the City Council. E. That the proposed proj ect is categorically exempt (Class 1) pursuant to the California Environmental Quality Act 15301. F. This project has been reviewed for consistency with the Air Quality Sub-Element of the City of Tustin General Plan and has been determined to be consistent or has been conditioned to be consistent with the Air Quality Sub-Element. Minor modifications 'at working drawings submittal may be submitted for review and approval by the Director of Community Development if found to be in substantial conformance with the approved plans. (1) 1.2 Unless otherwise specified, the conditions contained in the Exhibit shall be complied with prior to the issuance of any building permi ts for the proj ect, subj ect to review and approval by the Community Development Department. (1) 1.3 Design review approval shall become null and void unless all building permits are issued within eighteen (18) months of the date of this Exhibit. (1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of building permits. (1) 1.5 The applicant shall hold harmless and defend the City of # Tustin for all claims and liabilities arising out of the City's approval of the entitlement process for this project. ARCHITECTURE/SITE PLAN *** 2.1 Design Review 95-017 authorizes the establishment of a maximum of 21 seats located in the designated dining areas within the building. Any. modifications which increase the number of seats shall require approval of a parking Variance. (7) 2.2 There shall be no seating placed on the outdoor deck or the outdoor patio areas without prior approval of a Conditional Use Permit. (1) 2.4 All graffiti on the property shall be removed within 72 hours of a complaint being transmitted by the City to the property owner. Failure to maintain said structure and adjacent facilities will be grounds for City enforcement of its Property Maintenance Ordinance, including nuisance abatement procedures. (4) 2.5 All finish colors and materials to be consistent with the existing color and texture of the building elevations and roof elements, subject to final approval by the Community Development Department. (4) 2.6 At Building Plan Check, manufacturer's details of all lighting fixtures and a lighting plan which identifies the location, type of fixture, and intensity of all new exterior building mounted and free-standing lighting shall be provided. A note shall be provided on the plans that "All parking areas shall be illuminated with a minimum of one footcandle of light, and lighting shall not produce light or glare or have a negative impact on adj acent properties." All light fixtures shall be architecturally compatible with the proposed and existing structures and consistent with light design submitted with concept plans reviewed as part of Design Review 95- 017. (1) 2 . 7 As the subj ect property is located in the CuI tural Resource District, any exterior modifications or improvements to this building or site requires approval of a Certificate of Appropriateness. Therefore, approval of a Certificate of Appropriateness by. the Director of Community Development is required prior to the issuance of permits. (1) 2.8 Pursuant to Section 9408B of the City of Tustin Sign Code, the proposed individual business facility is permitted the following signs: a. Primary Wall Sign - One (1) primary wall sign for the purpose of business identification only. The sign area square footage may be equal to a maximum of 15% of the store front area not to exceed 75 square feet. Exhibit A Design Review 95-017 Zoning Administrator Action 95-010 Page 3 b. Secondary Wall Signs - Two (2) secondary wall signs for the purpose of business identification only. Secondary wall sign shall face onto a street, parking area, or service road. The sign area square footage may be equal to a maximum of 5% of the side or rear wall area not to exceed 25 square feet · Both side and rear wall of, the subj ect building would be eligible for secondary wall signs. c. Window Signs - A maximum of 25% of the store window area upon which the sign is located may be devoted to window sign use. Window signs may be permanent display or window lettering copy such as hours, address, phone number, emergency information, or special announcements. (1) 2.9 No sign component shall flash, blink, or be otherwise animated. Such animation is strictly prohibited. (1) 2 .10 All signs and their supporting structures shall be enclosed, structurally safe, and maintained in good condition and shall comply with the most current Uniform Building Codes, as locally amended. (1) 2.11 No outdoor storage shall be permitted except as approved by the Tustin Community Development Director. (l) 2.12 The trash enclosure shall be painted to match the residence. A separate solid metal, self closing, self latching gate shall be provided. Said enclosure shall be screened by a solid decorative wall consistent with the adjacent building's material and finish and be of a minimum height of six feet. The design details of the enclosure shall be submitted for Building Plan Check and are subect to approval by the Communi ty Development Department. The location of the bin, size and quantity shall be reviewed and accepted in writing by Great Western Reclamation. (1) 2.13 Prior to issuance of an On-site Improvement Permit the applicant shall submit an on-site improvement and pavement plan to show proposed drainage for the site, which may requ~re a drainage swale. Exhibit A Design Review 95-017 Zoning Administrator Action 95-010 Page 4 (1) 2.14 Prior to issuance of a Building Permit for the fence, the applicant shall provide details of the location and design of the proposed picket fence for review and approval by the Community Development Department. (1) 2.15 Prior to issuance of an On-site Improvement Permit, the applicant shall provide details of the qesign and color of the proposed stamped concrete patio areas, and any other information which may be necessary for electrical permits for the light fixtures proposed as part of the patio improvements, for review and approval by the Community Development Department. LANDSCAPING (6) 3.1 Prior to issuance of a Certificate of Occupancy, landscaping and irrigation information shall be submitted on a site plan and shall identify the type of planting materials proposed and the' type and location of irrigation system. (6) 3 .2 All plant materials shall be installed in a heal thy vigorous condition typical to the species and landscaping must be maintained in a neat and healthy condition. This will include but not be limi ted to trimming, mowing, weeding, removal of litter, fertilizing, regular watering or replacement of diseased or dead plants. (6) 3 .3 A note shall be added to the plan stating that the plants and irrigation will be installed in compliance with the City's Landscaping and Irrigation Guidelines. (6) 3.4 Provide summary table on the plans identifying the name, size and quantity of plants proposed and show the actual location on the plans. Note on plans that the Community Development Department may request minor substitutions of plant materials during Plan Check. Exhibit A Design Review 95-017 Zoning Administrator Action 95-010 Page 5 (6) 3.5 The irrigation plan shall show the location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. Note on landscaping plan that coverage of landscaping irrigation materials is subject to field inspection at project completion by the Community Development Department. Lands~aping and irrigation plans shall be submitted for new landscape areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements to the greatest extent" feasible, as determined by the Community Development Department. BUILDING DIVISION (3) 4.1 At building permit plan check, submit three (3) complete sets of construction plans. Requirements of the Uniform Building Code (UBC), State Historic Building Codes and State handicap requirements shall be complied with as approved by the Building Official. All construction shall be in accordance with the 1991 UBC, State Historic Building Codes, applicable City Codes and the City's Security Code. No field changes shall be made without corrections submitted to and approved by the Community Development Department. FEES (1) 5.1 Payment of all Building plan check and permit fees shall be made prior to the issuance of any building permits in accordance with the Tustin City Code. Payment will be required based upon those rates in effect at the time of payment and are subject to change.
