That a proper application, for Conditional Use Permit 95-018, was filed by alen Property Services to authorize professional and general offices and service commercial uses on a property located at 1371-1431 Warner Avenue. B. That a public hearing was duly called, noticed and held on said application on September 5, 1995, by the Zoning Administrator. C. That establishment, maintenance, and operation of the uses applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) The establishment of professional and general offices and service commercial uses will enhance the marketability of the Warner Corporate Business Park. The present design of the business park is conducive. to offices and commercial use in that the existing "Campus Like Setting" consists of mature trees and ground cover surrounding eleven two story glass walled buildings with direct pedestrian linkages between each building . around a central courtyard. 2) There is adequate parking on-site to accommodate the anticipated office and service commercial uses. No new parking spaces are required to accommodate approximately 72,446 square feet of potential Office/service commercial uses. 3) The traffic study conducted for the site assumed a 100% office/service commercial buildout of the site and found no negative impacts wquld result. The existing circulation system and level of service (LOS) for the Warner/Red Hill Avenue intersection (rCU) would remain at "A". That the establishment, maintenance, and ~P7ra~ion of the use applied for will not be 1nJur1ous or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin for the reasons stated in section C above. E. It has been determined that this project is a minor land use alteration to an existing facility and is, therefore, Categorically Exempt (Class 3) from the California Environmental Quality Act (CEQA). 12 The Zoning Administrator hereby approves Conditional Use Permit 95-018 to authorize the establishment of professional and general offices and service commercial uses on a property located at 1371-1431 Warner Avenue subject to the conditions contained in Exhibit A, attached hereto. (1) 1.2 The applicant shall hold harmless and defend the City of Tustin from all claims a"nd liabilities arising out of the City's approval of the entitlement process for this project. (1) 1.3 Approval of (CUP 95-018) is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.4 Conditional Use Permit 95-018 shall not become effective until Zone Change 95-001 is approved by the City Council and becomes effective. If Zone Change 95-001 is denied by the City Council, this CUP shall automatically become null and void. USE RESTRICTIONS **** 2.1 Retail commercial land uses are prohibited on-site, unless the applicant secures an approved amendment to this CUP or separate CUP specifically allowing retail commercial uses on-site in accordance with the PC-IND/BUS District Regulations. (1) 2.2 All uses permitted by the PC-Industrial/Business District regulations and the subject CUP shall meet the parking requirements of the PC-IND/BUS District Regulations. EXCEPTION (5) SPECZFZC PLAN (6) RESPONSIBLE AGENCY REQUIREMENT (7) LANDSCAPING GUIDELINES (8) PC/CC POLICY Exhibit A ZA Action 95-015 September 5, 1995 Page 2 PLAN SUBMITTAL (1) 3.1 Any new tenant business license applications that are a change in use or intensification of an existing use and all tenant improvement plans shall include an updated Building Use and Parking Summary identifying size, type of use and required parking for all current tenants and vacant suites to ensure that adequate parking is maintained for this project. The applicant shall provide the City with a hard copy of the Business Use and Parking Summary for City.internal use. FEES (1) 4.1 within 48 hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashiers check payable to the COUNTY CLERK, in the amount of $25.00 to enable the City to file with the County Clerk, the appropriate environmental documentation pursuant to the California Environmental Quality Act. If within such 48 hours period, the applicant has not delivered to the Community Development Department the above noted check, the approval for the project granted herein shall be considered automatically null and void.
