AMENDMENT TO CONDITIONS OF APPROVAL

4 The Zoning Administrator of the City of Tustin does hereby resolve as follows:
The Zoning Administrator finds and determines as follows:
A. That on April 28, 1997, the Planning Commission adopted Resolution No.
3522 recommending that the City Council approve Vesting Tentative Tract
Map 15427. The City Council approved Vesting Tentative Tract Map 15427
on May 5,1997 by adopting Resolution No. 97-35.
B. That Condition 2.3 of Resolution No. 3522 states that the installation and
completion of recreation improvements to the common Lot G are to be
completed prior to the issuance of Certificates of Occupancy for Phase II.
C. That the amendment will revise the timing of said improvements to be
installed and completed prior to the issuance of Certificates of Occupancy
for Phase III (as shown on the approved phasing plan), to accommodate
the construction of infrastructure improvements within the development.
D. Pursuant to Tustin City Code Section 9299b(4)(d), the Zoning Administrator
may consider requests for amendments to conditions of approval
established by the Planning Commission or City Council which are
determined to be minor in nature and do not alter the original intent of the
project.
E. Pursuant to Section 15061 (B)(3) of the California Environmental Quality Act
(CEQA), the project is exempt from the requirements of CEQA because
there is no possibility that it will have a significant effect on the environment.
The Zoning Administrator hereby approves an amendment to the Condition 2.3 of
Planning Commission Resolution No. 3522 to read as follows:

"Prior to the issuance of the first Certificates of Occupancy within Phase III
(as shown on the approved phasing plan), the developer shall complete the
installation of all improvements and common recreation facilities on Lot "G"."
All other conditions of Planning Commission Resolution No. 3522 originally
approving Tentative Tract Map 15427 shall remain in full force and effect.
