That a proper application for Design Review 99-044 was filed by James Mickartz requesting authorization to construct a free-standing 195 square foot accessory building for the purpose of installing two (2) Automated Teller Machines (ATM's) for use at a Wells Fargo bank location at 18356 Irvine Boulevard, within the Neighborhood Commercial (C-1) zoning district, "Community Commercial" General Plan land use designation and the Town Center Redevelopment Project Area. B. In accordance with Tustin City Code (TCC) Section 9299(b)(4)(c), the Zoning Administrator is authorized to review Design Review applications within Redevelopment Project Areas. C. That the Zoning Administrator reviewed the application on February 22, 2000. D. That the location, size, architectural features and general appearance of the proposed modifications will not impair the orderly and harmonious development of the area, the present or future development therein, the occupancy thereof, or the community as a whole. In making such findings, the Zoning Administrator has considered the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. 5. Towers, chimneys, roof structures, flag poles, radio and television antennas. 6. Landscaping, parking area design and traffic circulation. 7. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. . E. That this project involves minor modifications to an existing building, and is therefore Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15303 (Class 3) of the Act. F. That the project has been reviewed for consistency with the General Plan, including the Air Quality Sub-element of the City of Tustin General Plan and has been determined to be consistent with the General Plan, including the Air Quality Sub-element. The Director of Community Development may also approve minor modifications to the plans if such modifications are consistent with the provisions of the Tustin City Code. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 The subject project approval shall become null and void unless the use is established within twelve (12) months of the date of approval. Time extensions may be granted if a written request is received by the Community Development Department prior to expiration. (1) 1.4 Approval of Design Review 99-044 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's ap~roval of this project. Requirements of the Uniform Building Code (UBC) and Title 24 Disabled Accessibility requirements shall be complied with as approved by the Building Official. All construction shall be in accordance with the 1997 UBC, applicable City Codes and the City's Security Code. No field changes shall be made without corrections submitted to and approved by the Community Development Department. (1)(3) 2.2 Indicate on the title sheet the applicable codes, City, state and federal laws and regulations to include: · 1997 Uniform Building Code with California Amendments · 1997 Uniform Mechanical and Plumbing Codes with California Amendments · 1996 National Electrical Code with California Amendments · City of Tustin Grading and Security Ordinance · City of Tustin Landscaping and Irrigation Guidelines · City of Tustin Private Improvements Standards (1) 2.3 At building plan check submittal the following shall be provided: A. Preliminary technical details and plans for all utility installations including telephone and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. B. Details of all proposed lighting fixtures and a photometric study showing the location and anticipated distribution pattern of light of all proposed fixtures. All new light fixtures shall be consistent with the architecture of the building and subject to the approval of the Community Development Department. Provide a note on the plans, that "all exterior lighting shall be designed and arranged as not to direct light or glare onto adjacent properties or streets. Wall mounted fixtures shall be directed at a 90 degree angle directly toward the ground. All lighting shall be developed to provide a minimum of one (1) footcandle of light coverage, in accordance with the City of Tustin Security Ordinance". Exhibit A Zoning Administrator Action 00-005 February 22, 2000 Page 3 (3) 2.4 Provide a detectable warning at the ramp to the parking lot, such as grooved or "truncated domed" paving in accordance with California Building Code Section 1127B.5.10. (1) 2.5 A note shall be provided on final plans that a six (6) foot-high chain linked fence shall be installed around the site prior to building construction stages. A nylon fabric or mesh shall be attached to the temporary construction fencing. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. (1)(4) 2.6 All final colors and materials to be used shall be consistent with those on the main bank building and shall be subject to review and approval by the Community Development Department. All exterior treatments shall be coordinated with regard to color, materials and detailing and clearly noted on submitted construction plans and elevations. All exposed metal flashing or trim shall be painted to match the building. (1)(4) 2.7 Exterior elevations of the building shall indicate any fixtures or equipment to be located on the roof or exterior of the building, and the associated equipment heights and dimensions. The building parapet shall be an integral part of the building design, and shall screen all roof mounted equipment. All roof-mounted equipment and vents shall be a minimum of six inches below the top of the parapet. All exterior equipment, including gas and electric meters, shall either be enclosed within the building or boxed behind a screen wall architecturally consistent with the main building. USE RESTRICTIONS *** 3.1 The installation, configuration and operation of the proposed ATM Kiosk shall comply with the State mandates set forth in the Legislative Counselors' Digest, as it relates to Automated Teller Machine User Safety. *** 3.2 A minimum of two (2) video cameras shall be installed on or around the kiosk to record pedestrian traffic coming to and going from the ATM Kiosk. The cameras shall have 24 hour recording capability and be maintained in good working order. FEES (1)(5) 4.1 Prior to issuance of any building permits, payment shall be made of all applicable fees, including but not limited to the following. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. ExhibitA Zoning Administrator Action 00-005 February 22, 2000 Page 4 A. Building plan check and permit fees to the Community Development Department based on the most current schedule. B. Transportation System Improvement Program (TSIP) Area "Au fees in the amount of $5.53 per square foot of new building floor area. C. Orange County Fire Authority plan check and inspection fees to the Community Development Department based upon the most current schedule. (1)(5) 4.2 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty eight dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
