HomeMy WebLinkAboutZA 00-008/UD 00-004 2 3 ZONING ADMINISTRATOR ACTION 00-008 USE DETERMINATION 00-004 The Zoning Administrator of the City of Tustin does hereby resolve as follows: 4 5 I. 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 The Zoning Administrator finds and determines as follows: A. That a proper application for Use Determination 00-004 was filed by Hwang Chung requesting a use determination to provide tutorial services as an ancillary use to a retail use within an existing building located at 3021 Edinger Avenue more specifically described as Parcel 9 of Parcel Map 97- 164. B. In accordance with Section 3.6 of Jamboree Plaza Planned Community Regulations, tutorial services is not a listed use and requires a Use Determination by the Community Development Director. The Community Development Director referred consideration of this request to the Zoning Administrator. C. That a public hearing was duly called, noticed and held on said application on May 8, 2000 by the Zoning Administrator. D. The Zoning Administrator finds that the proposed use will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. E. The Zoning Administrator finds that approval of the use determination to allow tutorial services within the Planning Area B of Jamboree Plaza Planned Community can be supported by the following findings: 1 ) The proposed use is consistent with the overall intent of the Planning Area B of the Jamboree Plaza Planned Community, which is to promote development of retail and commercial businesses and services in that the proposed tutorial use would be ancillary to the retail portion of the facility. 2) The proposed use is consistent with permitted and conditionally permitted uses within the planned development in that a variety of retail and service uses are permitted and conditionally permitted. 3) The proposed use is consistent with the other listed permitted uses in that tutorial facilities typically do not generate more traffic or noise otherwise associated with other permitted/conditionally permitted uses. To ensure compatibility, as conditionally permitted uses, proposals for tutorial services would be reviewed on a case by case basis. oning Administrator Action 00-008 ay 8, 2000 age2 2 4) To ensure sufficient parking for the facility, tutorial services would be required to provide one (1) parking space per two (2) two students and one (1) parking space per instructor. 3 4 5 5) The proposed use is consistent with the General Plan's Planned Community Commercial/Business land use designation which provides for a variety of commercial uses within the Community Commercial, Professional Office, and Industrial land use designations. 6 7 8 F. That this project is Categorically Exempt pursuant to Section 15301 (Class 1) of the California Environmental Quality Act. 9 10 II.
