The Zoning Administratorfinds and determines as follows: 5 That a proper application for Conditional Use Permit 00-013 was filed by Karen Peters of the Orange County Fire Authority (OCFA), requesting authorization to temporarily locate two (2) trailers along the western property boundary of Fire Station #21, located at 1241 Irvine Boulevard, to be used as living quarters and administrative office space during seismic retrofit construction for a maximum of six months. Pursuant to City Code Section 9299b(3), the Zoning Administrator has the authority to approve a temporary use not to exceed six months through a conditional use permit. 10 11 12 That a public hearing was duly called, noticed and held on said application on June 12, 2000 by the Zoning Administrator. C. 13 14 D. That the proposed site is within the "Public and Institutional" land use designation of the General Plan which provides for public services and uses, including Fire Stations. 15 16 That the establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin, as evidenced by the following findings: E. 17 18 19 20 21 1) The proposed temporary use, as conditioned, would not be detrimental to the surrounding properties in that the trailers would be set back from Irvine Boulevard and would be screened from adjacent properties by block walls. 22 23 24 As conditioned, the use would not have a negative effect on the surrounding properties in that the trailers would allow normal fire fighting operations to continue at the fire station during the seismic retrofit construction. 2) 25 26 27 28 3) As conditioned, the use would terminate by December 12,2000, and the applicant would be required to remove the two (2) trailers and related equipment. 29 F. That this project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15303 (Class 3). EXHIBIT A ZONING ADMINISTRATOR ACTION 00-010 CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT 00-013 GENERAL (1) 1.1 The proposed use shall substantially conform with the submitted plans for the project date stamped June 12, 2000, on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development in accordance with this Exhibit. The Director of Community Development may also approve minor modifications to plans during plan check if such modifications are to be consistent with the provisions of the Tustin City Code and other applicable codes. (1) 1.2 Approval of Conditional Use Permit 00-013 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.3 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval of this project. USE RESTRICTIONS (1) 2.1 The Temporary Use approved under this Conditional Use Permit shall expire six (6) months from June 12, 2000. The applicant shall remove all trailers and equipment by December 12, 2000. (1 ) 2.2 All operations shall comply with the City of Tustin Noise Ordinance. *** 2.3 The trailers may only be used for the temporary living quarters of fire personnel or as office space for the fire station's operations. FEES (1)(5) 3.1 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty eight dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. That the project has been reviewed for consistency with the Air Quality Sub- element of the City of Tustin General Plan and has been determined to be consistent with the Air Quality Sub-element. 4 5 6 II. The Zoning Administrator hereby approves Conditional Use Permit No. 00-013 authorizing the temporary installation of two (2) trailers at Fire Station #21, located at 1241 Irvine Boulevard, for a period of six months, subject to the conditions contained within Exhibit A, attached hereto. 7 8 9 PASSED AND ADOPTED by the Zoning Administrator of the City of Tustin at a regular ]0 meeting held on the 12th day of June, 2000.
